A registered trademark in India is valid for 10 years from the date of registration, and missing the renewal deadline does not mean you instantly lose your mark — you get a 6-month grace period to renew with a surcharge, and if you miss that too, a further window (up to one year from the expiry date) to apply for restoration. After that one-year mark, the trademark is removed from the register and can, in principle, be picked up by someone else.

When is a trademark due for renewal?

A trademark must be renewed every 10 years from the date of registration to remain valid and enforceable. Renewal is filed on Form TM-R and can be submitted any time up to one year before the expiry date, under Rule 57 of the Trade Marks Rules, 2017. The Trade Marks Registry typically also sends a reminder notice before expiry, but this is a courtesy, not a legal safety net — tracking the deadline is the owner's responsibility.

What happens in the first six months after expiry?

If you miss the expiry date, you have a 6-month grace period during which the mark stays on the register and can still be renewed, provided you pay the standard renewal fee plus a late surcharge (still filed on Form TM-R, under the proviso to Section 25(3) of the Trade Marks Act read with Rule 57(2)). This is the cheapest, simplest way to fix a missed deadline — a straightforward late renewal, not a restoration proceeding, and it happens more or less as of right once the fee and surcharge are paid.

What if I miss the six-month grace period too?

If the mark isn't renewed within six months of expiry, the Registrar removes it from the register, and the removal is ordinarily advertised in the Trade Marks Journal. You're not immediately out of options: under Section 25(4) and Rule 60, an application for restoration and renewal — still on Form TM-R — can be filed between six months and up to one year from the date of expiry. Restoration is discretionary, not automatic: the Registrar must be satisfied it's "just" to restore the mark, considering the interests of any third parties who may have been affected in the interim.

Can someone else register my trademark after it's removed?

Yes — this is the real danger of letting a renewal lapse for good. Once a mark is off the register, a third party can, in theory, file for an identical or similar mark. There's a partial safeguard: under Section 26 of the Trade Marks Act, a mark removed for non-renewal is still given some residual consideration for a period after removal when the Registrar examines a new, similar application, but this protection is not absolute and doesn't stop someone from filing. If your registration is never restored and formally lapses, you'd need to file a brand-new application, which gets a fresh filing date with no guarantee against intervening filings — though evidence of your prior use can still help your case.
