    What is Trademark Renewal?

A Trademark Registration is granted for a term of 10 years in India. The renewal of the trademark is necessary to continue enjoying your ownership rights over it.

You must renew your trademark before 6 months from the date of expiration or within one year of expiration with a prescribed surcharge. Trademark Renewal in India can help you keep your trademark perpetual and permanent, as there are no restrictions on how many times and for how many years you wish to keep your trademark status active and registered.

Registration of the trademark awards the holder of the trademark many rights that are protected by law. Don't let them expire.

    Benefits of Renewal

    Legal Protection

Prevents infringement of the trademark and provides restitution in case of such infringements. Without renewal, you lose the legal right to sue.

    Monetary Value

A registered trademark holds immense monetary value. Licensing (franchising) is only possible if the holder maintains an active registration.

    Transfer Rights

Allows the holder the right to transfer the trademark to another person or company at their will. Expired marks cannot be transferred.

    Perpetual Rights

With timely renewal, the original owner can enjoy the exclusive rights of the mark forever, preventing anybody else from claiming it.

    Frequently Asked Questions

    What is Trademark Renewal?

A trademark registration in India is valid for 10 years. To maintain ownership rights, you must renew it within six months before expiry, or within one year after expiry (with a surcharge). Renewal can be done indefinitely to keep the trademark active and perpetual.

When do I need to apply for Trademark Renewal in India?

You should file the renewal within six months before the ten-year expiry. However, you can still renew within one year after expiry by paying the prescribed late fee.

    What if the trademark expires?

If it expires, you can apply for restoration within six months post-expiration. Note: this involves additional fees and carries risk.

What is the Trademark Renewal process in India?

Renewal can be filed online or offline, usually through a registered trademark attorney. The process includes paying the renewal and any late fees. Before expiry, the Registry will send a notice. If missed, the mark is removed but can be renewed within the one-year extension.

Is the trademark valid outside India?

No. Trademarks are territorial and valid only in the country of registration. You must file separately in each country, either directly or via mechanisms like WIPO or EU‑wide systems.

What are the consequences of failure to renew the trademark?

Failure to renew leads to the mark being removed from the register, allowing others to claim it. Any associated licenses will also become void.

The "Restoration" Safety Net for Trademark Renewal

A common panic scenario we see in Kerala is a business owner realizing their trademark expired 8 months ago. They assume the brand is lost. It isn't.

    The 6-Month to 1-Year Window

The law understands that business owners get busy. If you miss the 10-year deadline, you enter the "Grace Period" (0-6 months post-expiry). If you miss that too, you enter the "Restoration Period" (6 months-1 year post-expiry).

    Form TM-R & Penalties

You can file for Restoration of the mark. This is slightly more expensive than a standard renewal and requires a statement explaining the delay. However, it completely revives your original registration date.

Warning: Once 1 year has passed since expiration, the mark is legally "Dead." It is removed from the register, and the name becomes available for any competitor to snap up.

Why Trademark Renewal is Strategic, Not Just Administrative

    Brand Valuation

If you plan to take a business loan or sell your company, the auditor will value your brand. A trademark with a "Registered since 2000" status is an asset. A lapsed trademark is a liability.

    Litigation Strength

In court, a trademark that has been renewed multiple times acquires a status of "incontestability" on certain grounds. It proves you are serious about defending your rights.
