Trademark Objection Show Cause hearing is the final stage for acceptance or refusal of the Trademark application in India.
Generally, the hearing date is informed via mail or physical copy. However, it is advisable to keep watching the trademark status every 10 days once the status shows ‘Ready for Show Cause Hearing’.
Do not leave the hearing unattended. Failure to appear often results in the refusal of the Trademark Application without considering its merit.
Normally, an applicant is awarded 3 hearings to defend objections. Extensions can be filed (Form TM-M) if needed.
Hearings take place at Chennai, Mumbai, Ahmedabad, Delhi, and Kolkata registries.

Since 2020, hearings are conducted via Video Conferencing. You can sit in our office in Kochi while our attorney presents your case to the Hearing Officer in Chennai or Mumbai.
Often, the Hearing Officer decides on the spot. If convinced, they will move the application to "Accepted & Advertised." If not, they may ask for more written submissions.
Sometimes, you need to buy time (e.g., to gather 10-year-old invoices).
You can request an adjournment, but the Registry is strict. You generally get a maximum of 2 adjournments.
You must file the request at least 3 days before the hearing. Ignoring a hearing notice leads to immediate "Abandonment" of your application. Reviving it after that is difficult and costly.
